Wendell loves to buy merchandise that is advertised on TV. There is just something about the way the equipment is advertised that makes him reach for his phone. He has at least one of every product made by Popeil. In any event, he recently bought a "Weed TERMINATOR" when it was advertised during his favorite bass fishing program. The advertisement said that "anyone could use it" and "just turn it on and the weeds are gone" [very poor rhyming]. The TERMINATOR looked harmless enough, so he didn't read the instructions; instead, he went to the side of his house to take care of some particularly pesky weeds. There were no instructions or warnings on the TERMINATOR. The instructions were on a sheet of paper in the bottom of the box. Wendell wielded the TERMINATOR on an angle so that he could take the weeds off just below the surface of the dirt. Unfortunately, the steel filament of the TERMINATOR kicked up some pebbles and projected them into his eyes. He suffered serious damange to one of his eyes. The TV demonstrator was wearing safety glasses and the instructions indicated that safety glasses should be worn. The instructions also warned that the TERMINATOR should be held level to avoid hitting loose objects. Wendell's complaint asked for compensatory damages of $5Million and punitive damages of $100Million. What result?Graf 09 March 2002 1:00 pm -- 5:00 pm
