Len Simon addressed the students of SDSU's Sports Business MBA program on November 2, 2005. Mr. Simon is a sports law attorney and also serves on the San Diego Padres board of directors and is an adjunct law professor for Duke University, the University of San Diego, and the University of Southern California law schools. He spoke with the students of the program on the topic of franchise relocation.
Mr. Simon focused on the history of franchises moving within the National Football League. Specifically, he discussed the power strategy of the NFL, granting exclusive rights to current market tenants, purposely leaving viable markets void of teams, and the leverage that teams have when asking host cities for new/renovated stadiums. He provided insight on the pros and cons of the Chargers' lease with the city of San Diego, and the repercussions that lease has had on the team's current status.
The class discussed the case of Al Davis versus the NFL in great detail, along with some of the misconceptions from that case. Len Simon looked into the validity of Davis's anti-trust claims and analyzed the fact that his ruling actually only set precedent for the 9th circuit, not the nation. Davis's "victory" lies in the fact that it would take millions of dollars on both sides to go to court again, and the NFL does not see this as a fiscally responsible alternative. Also, Professor Simon explained the importance of the NFL retaining its ability to approve or deny the viability of potential markets for future franchises.
